Texas man files a lawsuit citing ELITE IVC filter's failure

A Texas resident, who alleges he was injured when he was implanted with Option ELITE's IVC Filter, has filed a lawsuit against the medical device's manufacturers Aragon Medical Devices, Inc. and Rex Medical L.P. The surgery that resulted in the implementation of the device took place at Austin's Seton Medical Center on July 23, 2015.

The plaintiff in this case had been previously diagnosed with deep vein thrombosis, or blood clots within his legs, prior to the surgery being ordered. The expectation of doctors was that, by inserting the filter, the man's propensity to develop blood clots that would travel within his bloodstream to his lungs and cause a pulmonary embolism, would be prevented.

Instead, despite the implantation of the medical device, by November 9, 2015, the man was later determined to have developed multiple clots in both lungs. The man's CT scan that same day also revealed that the there were other blood clots that had become trapped in the man's IVC filter and one of his veins. He was forced to go under the knife as a result once again.

Although the man had a number of medical procedures performed on him that same day in an effort to remove the clots, including a thrombolysis, venogram, and AngioJet thrombectomy, they all failed. As a result, the defective medical device is destined to remain permanently inside the man's body.

The man is suing the device's manufacturer for failing to properly test the device in a clinical setting to how leaving the product in the patient's body would impact his or her health over time. His lawsuit alleges that the defective product should have never been sold on the market.

Defective medical devices that are left inside a patient's body have the potential of not only not remedying the intended medical ailment they were intended to address, but also can cause long-term health complications or patient death as well.
