Texas 1 of 4 states without statewide ban on texting and driving

Did you know that Texas has no statewide law against texting and driving? Currently, it's only one of four states with such a ban. There are many cities that have ordinances banning texting while driving, including Arlington.

With one in five accidents involving a distracted driver, it's important to know just how dangerous driving while texting is. For those with cellphones who drive, there are certain prohibitions that apply. Here are a few:

-- Any Texas driver who has a permit cannot use a handheld cellphone while driving within the first six months.

-- Drivers in school zones are not allowed to text or use a handhold device.

-- If a driver is under 18 years old, he or she is not allowed to use any type of wireless communication device.

-- A school bus driver is not allowed to use a cellphone if there are children on the bus.

For those who are convicted of a cellphone offense, the fines can be between $200 and $500. Since November 2009, almost 40 cities have ordinances in place regarding the use of cellphones while driving.

Those who are injured because of a distracted driver do have recourse when it comes to seeking compensation. A civil lawsuit may be necessary if there cannot be an acceptable settlement offer from the insurance company. A lawyer experienced in personal injury cases can help you learn more about how to proceed with such a lawsuit. Drivers who cause serious or even fatal accidents because of distracted driving can and should be held accountable for their negligence and/or recklessness.
