Does an auto defect give rise to legal liability?

For many prospective car buyers, safety features are an important factor in their decision-making process. Carmakers have responded to that consumer demand by including safety features in their advertisements. Yet when a product does not work the way it was advertised, does a consumer have any legal rights?

A personal injury attorney that focuses on product liability lawsuits knows that answer to be yes. Products that cause injury due to a design defect may subject the manufacturer to liability. In addition, a carmaker that has notice of a dangerous or defective car part but fails to timely issue an auto recall could also find itself facing liability.

In a recent news release, the U.S. National Highway Traffic Safety Administration has ordered a Japanese air bag suppler, Takata Corp., to expand the scope of its recall of driver-side airbags. The company's original recall was limited to states with high humidity. However, NHTSA officials have called for a nationwide recall, giving the company a deadline for issuing the nationwide recall.

According to NHTSA officials, the company's failure to comply could result in fines of up to $7,000 per vehicle. However, an attorney knows that such fines might not be official until the NHTSA begins proceedings against the company. In the same way, it is sometimes necessary to bring a product liability suit to protect a consumer's legal rights. Check out our firm's product liability page to learn more about the process. An attorney can help you seek compensation for any injuries arising from a dangerous or defective product.
