Defective products might cause injury before they are recalled

An automotive safety feature that was designed to save lives recently claimed the life of a 35-year-old Texas man.

According to a civil complaint filed by the man's surviving family members, the air bag in the man's 2002 Honda Accord may have unexpectedly inflated and/or exploded. Unfortunately, it may also have sent a piece of metal into the man's neck, inflicting a fatal injury.  

The air bag is manufactured by Takata Corp. of Japan and is used by numerous automakers. Unfortunately, this tragedy is not an isolated incident. The manufacturer has been implicated in five other deaths and even more non-fatal incidents. According to the allegations, the air bag inflators shoot out metal and/or plastic pieces when they explode.

When a product does not operate the way that it is supposed to due to a defect, consumers have a right to expect the manufacturer to issue a recall. In this case, around 12 million vehicles have been recalled in the United States. Worldwide, the total is about 19 million.

The extra danger in this instance of an allegedly defective product is that the malfunction may occur while a vehicle is in use. In addition to endangering the driver, an exploding airbag could also lead to a motor vehicle accident. That could lead to multiple theories of liability in a civil lawsuit, including product liability and personal injury law.
